we would like to inform you that the Minister of Infrastructure, in consultation with the Minister of National Defense and the Minister of Internal Affairs and Administration, issued the Regulation on aviation obstacles, obstacle limiting surfaces and hazardous devices. The regulation has not yet been published. Its publication is expected to take place by February 11 this year.

Pursuant to § 27 of the Regulation, an aviation obstacle being a wind farm is marked by painting in white. The rotor blades, nacelle and 2/3 of the upper part of the supporting structure are painted. It is a change in the rules of marking in comparison with the Regulation of the Minister of Infrastructure of June 25, 2003 on the method of reporting and marking air obstacles that have expired.

In accordance with the transitional provisions, entities obliged to mark aviation obstacles with marking in accordance with the requirements set out in the Regulation of the Minister of Infrastructure of 25 June 2003 on the method of reporting and marking aviation obstacles (Journal of Laws, item 1193 and of 2006, item 53) shall adapt the day or night marking of these obstacles to the requirements of this Regulation at the next renovation of the day or night marking, respectively.

The regulation will enter into force on the day of its publication.

PWEA is working on the development of further transitional provisions, which are aimed at enabling the use of aviation obstacle marking in accordance with the rules of the 2003 regulation for investments that commenced before the new regulation enters into force.

The above action will allow for the completion of commenced investment processes without the need to incur additional costs by investors (these costs would result from the need to adapt individual elements of wind farms that have already been ordered / manufactured to new painting requirements).
